Terms of Service

Introduction

Welcome to Knowledge Graph ("the Plugin"), an Obsidian plugin developed by Knowledge Graph team. These Terms of Service ("Terms") govern your use of the Plugin. By installing, accessing, or using the Plugin, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Plugin.

1. License Grant

Subject to these Terms and any applicable fees, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Plugin on devices you own or control, solely for your personal, non-commercial use, unless explicitly authorized for commercial use through a separate license agreement.

2. Subscription and Billing

The Plugin offers both free and paid ("Pro") subscription tiers:

  • Free Tier: Provides access to basic features including local model support and read-only graph view, available at no cost.
  • Pro Tier - Monthly Subscription: Provides access to all features including cloud model support, graph search, and custom prompts. Billed on a monthly recurring basis.
  • Pro Tier - Annual Subscription: Provides the same features as the monthly Pro subscription, billed on an annual recurring basis at a discounted rate.
  • Price Changes: We may adjust subscription prices at any time. We will provide reasonable notice of any price changes before they take effect.

3. User Responsibilities

As a user of the Plugin, you agree to:

  • Use the Plugin in compliance with all applicable laws and regulations.
  • Not use the Plugin to process any content that infringes on third-party rights, violates laws, or contains malicious code.
  • Not attempt to reverse engineer, decompile, or modify the Plugin except as expressly permitted by applicable law.
  • Not distribute, share, or transfer your license key or subscription access to unauthorized third parties.
  • Keep your API keys and license information secure and confidential.
  • Be responsible for all data and content you process through the Plugin.

4. Third-Party Services

The Plugin may integrate with third-party AI model providers including but not limited to OpenAI, Anthropic, and Ollama. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for any terms, conditions, fees, or data handling practices of third-party service providers.

  • You are responsible for obtaining and maintaining valid API keys for third-party services you choose to use.
  • You are responsible for any fees charged by third-party service providers.
  • Local model support (Ollama) requires separate installation and configuration on your device.

5. Intellectual Property

The Plugin, including all code, documentation, graphics, logos, and other content, is protected by copyright and other intellectual property laws. We retain all rights, title, and interest in and to the Plugin, including all modifications, enhancements, and derivative works. Your use of the Plugin does not transfer any intellectual property rights to you.

6. Disclaimer of Warranties

THE PLUGIN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Plugin will operate uninterrupted, error-free, or meet your specific requirements. The use of AI models for document analysis involves inherent uncertainties, and results may not always be accurate or complete. You are responsible for reviewing and verifying all analysis results.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE PLUGIN.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE PLUGIN EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE PLUGIN IN THE TWELVE (12) MONTHS PRECEDING THE DATE OF THE CLAIM.

8. Data Responsibility

You are solely responsible for the content you process through the Plugin. We recommend regular backups of your Obsidian vault and important data. We are not responsible for any data loss, corruption, or unauthorized access that may occur through your use of the Plugin.

9. Termination

You may terminate your use of the Plugin at any time by uninstalling it from Obsidian. We may suspend or terminate your license to use the Plugin if you violate these Terms or engage in behavior that could harm the Plugin or other users. Upon termination, all rights granted under these Terms cease immediately, and you must cease all use of the Plugin.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the primary developer is based, without regard to its conflict of law principles.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date above. Your continued use of the Plugin after such changes constitutes your acceptance of the revised Terms.
